THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment to Your Privacy

OxyPeak Longevity is required by law to maintain the privacy of your protected health information (PHI), to provide you with this notice describing our legal duties and privacy practices, and to abide by the terms of this notice while it is in effect.

How We May Use and Disclose Your Health Information

1. Treatment. We may use and disclose your health information to provide, coordinate, or manage your hyperbaric oxygen therapy and related care, including sharing information with other providers involved in your care.

2. Payment. We may use and disclose your health information to bill and collect payment for services, including submitting claims to Medicare or your health insurance carrier and verifying coverage.

3. Health Care Operations. We may use and disclose your health information for activities such as quality assessment, compliance auditing, staff training, and business management.

4. Required by Law. We will disclose your health information when required to do so by federal, state, or local law.

5. Public Health and Safety. We may disclose your health information to prevent a serious threat to health or safety, or as required for public health activities.

6. Other Required and Permitted Uses. As applicable, we may also use or disclose your health information for: health oversight activities; judicial and administrative proceedings; law enforcement purposes; coroners, medical examiners, and funeral directors; workers’ compensation programs; organ and tissue donation purposes; research, subject to applicable safeguards; specialized government functions, including military and national security purposes; situations involving victims of abuse, neglect, or domestic violence; disclosures to avert a serious threat to health or safety; and other uses and disclosures required by law.

7. Substance Use Disorder Records. If your record includes information about treatment for a substance use disorder that is protected under 42 CFR Part 2, that information receives additional federal confidentiality protection and may be used or disclosed only with your specific written consent, except in limited circumstances specifically permitted by federal law and regulation.

8. Business Associates. We may disclose your health information to companies that perform services on our behalf, such as our electronic health record, accounting, and laboratory partners, each of which is required by written agreement to protect your information.

9. Other Uses. Any use or disclosure of your health information not described in this notice, including use of your health information or testimonial for marketing purposes, will be made only with your written authorization. You may revoke that authorization in writing at any time, except to the extent we have already relied on it. Certain categories of information receive special authorization treatment where applicable, including psychotherapy notes, use of your information for marketing, sale of your health information, and substance use disorder records protected under 42 CFR Part 2.

Reproductive Health Care Information. Federal protections for reproductive health care information have been the subject of recent litigation and regulatory change; a federal court vacated much of a 2024 federal rule addressing reproductive health care information while leaving certain related notice provisions in effect. We will apply the current, legally operative standard, rather than an earlier pre-litigation version, to any use or disclosure of reproductive health care information.
